sleep-apnea-mask-photo-300x212Last month, Philips issued a huge recall of many of its ventilators and continuous positive airway pressure (CPAP) machines meant to help those struggling with sleep apnea. The company has issued the recall with no answers as to when the products will be fixed and available again, leaving many people feeling lost without an alternative. People with sleep apnea need these machines to get a good night’s sleep and ensure their safety during the night. Untreated sleep apnea can result in a slew of health problems; everything from anxiety and tiredness to high blood pressure, heart attacks, or strokes. Leaving people without treatment for their sleep apnea is potentially dangerous. However, the problems with these machines need to be resolved before they are safe to use.

What is the Problem with Phillips’ CPAP Machines?

The issue with these devices is the foam that is inside of them, a polyester-based polyurethane (PE-PUR). This foam is meant to reduce the sounds and vibrations that come from the device, but it has recently been discovered that this foam also has the potential to break down inside the device and enter the air pathway of the machine, leading to the possibility of being inhaled or swallowed by the person using it. The foam also may release chemicals into the airway of the device, which would then be inhaled by the user.

Shawn-3-Copy-300x177Yesterday, lawyers for the plaintiffs in the cases against Sterigenics held a press conference to expose what we have recently learned about the apparent attempts of Sterigenics and its corporate owners to make it more difficult for our clients who prove their cases to receive just compensation.  As we detail in our newest court filing (and as summarized below), in the two years since the federal government in 2016 concluded that ethylene oxide is 30 times more potent of a carcinogen than previously believed, Sterigenics and its owners have taken $1.3 billion in cash out of the company, put it in their own pockets, and replaced it with money borrowed from banks.  The effect of this is to put company cash and other assets out of reach of plaintiffs who prove that Sterigenics caused their cancers.

Rest assured:  we will expose this behavior, get to the bottom of it, and hold Sterigenics accountable in court for anything they have done here that is unlawful.  We will bring this behavior before the Judge and jury, and demand justice—which includes just compensation for our clients who prove their cases.

This past Friday, we filed an amended complaint adding new allegations to our lawsuits. The new allegations are as follows:

You don’t know where to turn or what to look for. It can feel almost impossible, especially if you don’t know any lawyers. Many people ask friends or business acquaintances for recommendations, which can be a good start. Others turn to the internet to begin a confusing and daunting search. Either way, the consequences of choosing the wrong lawyer can be catastrophic. So, what do you need to know? What qualifications are you looking for? How do you know who to trust? How do you know the lawyers are good at their job? Here are some important things you need to consider when looking for the right lawyer to represent you.

Does the lawyer have experience? To be precise, this question should be worded: Does the lawyer have the right kind of experience? Look on the law firm website. Do they list your type of problem on their practice area page? What areas of the law are emphasized? Do they have a page that covers the issues involved with your kind of case? Do the lawyers’ profiles talk about working on your kind of case? This is important. The law is very complicated and it isn’t possible for a single lawyer to be able to handle every type of case well. Most lawyers concentrate in specific areas of the law. If a lawyer does mainly banking, for example, then she may not be the right choice for a personal injury case, and vice versa. If you have an environmental case, you will need an environmental lawyer. If you have a business litigation problem, choose a business litigation lawyer, and so on. In addition, check out whether the lawyer is a defense lawyer or a plaintiffs’ lawyer. And finally, ask the lawyer directly if he or she has experience handling your kind of case.

What kind of qualifications does the lawyer have? Start with his or her education. Research the law school he or she attended. Is it well regarded? Does the lawyer have other relevant education? An accounting degree, for example, can be very useful if you have a case with lots of business financials involved. Has the lawyer taught law school; written books, articles, or blogs on a certain area of the law; or created videos on specific legal topics? All of these things help to prove that a lawyer is qualified to handle your case.
