Srail v. Illinois-American Water, et al

On May 9, 2007, a family in the Oak View subdivision of Lisle (Illinois) filed a federal class action lawsuit against the Village of Lisle and
Illinois-American Water Company, alleging misconduct that has caused the Oak View water system to be “so inadequate that it cannot
reliably deliver even the minimum water pressure necessary to put out a fire at a home or school in the neighborhood.” (A copy of the

The lawsuit was filed by Susan and Jeffrey Srail, on behalf of themselves and approximately 400 other families living in Lisle’s Oak
View subdivision. The Oak View water system is maintained and operated by Illinois-American, under a contract with the Village of
Lisle that allows Illinois-American to be the exclusive provider of water to the Oak View families.
The Srails have sued the Village of Lisle for refusing to provide the Oak View residents the properly-functioning water system which the
Village has provided its other residents, and for refusing to demand that Illinois-American comply with its responsibility to obey state law
and provide a safe water system.
The Srails have sued Illinois-American for its “reckless failure to maintain the Oak View system” which has led to water pressures far
below those required by State law, and fire hydrants within the system which do not work. Illinois-American also does not even
regularly test the Oak View system to determine whether it is working.
Naperville attorney, Shawn Collins, representing the Srail family stated: “This is a terrible situation that no family should be forced to live
with. The Village of Lisle has trapped the Srails and their Oak View neighbors by granting Illinois-American a monopoly over Oak View
water, which the company did not deserve. As often happens with companies which have no competition, Illinois-American since has
miserably failed to take even the most basic steps to provide a safe water system, and Lisle has refused to hold Illinois-American
accountable.”
